Throughout history, there has always been a defining element of a higher status within society that policed the actions of man and government to maintain law and order in legal and judicial forums. Whether it be the laws of war established at the Geneva Convention or universal parliamentary procedure, these standards maintain decorum while debating law and justice in a civil society.
Legislatures are a key component in representative democracy. In a democracy, the legislature has real political power since it is vested in the legislative body. In addition to passing laws that protect the people and maintain liberty, legislatures police government’s operations and structure. Legislatures define the missions of agencies and establish most fundamental operating policies.

Every legal assembly has an inherent right to regulate its own procedures within its constitution. A constitution serves as the law of a state or nation. Parliamentary procedure is a logical method of maintaining decorum in committees or in the assembly. This is the most used method of decorum.
Most judicial assemblies follow a set of ethics established by past judiciaries such as Roberts Rule of Order. Jefferson’s House Rules are the oldest rules governing ethical legislative House conduct.
Others include Atwood’s Rules, and the Democratic Rules of Order used within private meetings.
In most democracies, our legislative floors have been respected by dissidents and protesters. But with the rise of young progressives and their disruptive protests, states and the federal government fear anarchy, insurrection and even armed conflict will seize control of assembly floors at any time.
Montana transgender state Rep. Zooey Zephyr, a Democrat, recently told fellow legislators in the state House they had “blood on their hands” during session following a raucous transgender demonstration at the Capitol. Zephyr has constantly violated the Montana legislative House decorum since elected.

The state’s House voted last week to bar the transgender Democrat from the floor for the rest of the session. This is a most recent example of lawmakers acting post haste to preserve legislative decorum. After what happened January 6th, 2021, in Washington D.C., they fear if they don’t punish those who breach ethics immediately it’s likely that protesters will start taking over the assembly floors.

Attorneys for Zephyr sued House Speaker Matt Regier and Sergeant-at-Arms Bradley Murfitt on behalf of Zephyr for reinstatement. Emily Flower of Montana’s Attorney General’s office said, “This is performance political activism masquerading as a lawsuit.” She said a court decision blocking the Legislature censure would violate the separation of powers between branches of government.

Montana is far from alone in its aggressive crackdown on defiant lawmakers using the chamber floor as a protest forum. Across the U.S., activist legislators have been disrupting proceedings with overheated language, outrageous accusations and cacophonous protests. State legislative leaders are swiftly punishing anyone who violates parliamentary procedure and “Robert’s Rules of Order.”
In Oklahoma last month, progressive Rep. Mauree Turner was removed from all committees and censured for breaking decorum and assaulting a police officer and another lawmaker during a transgender protest. She was offered the chance to keep the committee seats by issuing a formal apology but said; “I think an apology for loving the people of Oklahoma is something I cannot do.”
The Arizona House voted April 12 to expel GOP Rep. Liz Harris after an ethics committee found that she violated the chamber’s rules by “eroding the public trust in the legislative process” with her “disorderly behavior.” She accused her colleagues of criminal activity, including taking bribes from the Sinaloa drug cartel, and hid the testimony from House leaders, which misled the investigators.
House Speaker Ben Toma said, “What should have been a joint hearing to examine commonsense election reforms devolved into disgraceful fringe theater.” Harris called the report “a lie” and told reporters the expulsion vote was “an example if you don’t toe the line this is what happens to you.”

In the Volunteer state of Tennessee, last month the House voted to expel two progressive representatives who commandeered the podium during session. They smuggled in a bullhorn to protest for gun control legislation and led chants from a gang of noisy protesters who came with them sitting in the galley.
State Reps. Justin Jones and Justin Pearson had been leading protests at the capital for weeks.
This was not the first time Jones made the news for participating in an injurious protest near the Capital. During Black Lives Matter’s summer of love, a Blog Scoop video shows that Jones blocked traffic and assaulted an innocent driver with a traffic cone during a brawl in 2021.

Earlier in the month, Jones and at least two other progressive state representatives encouraged a crowd of more than 1,000 protesters to breach the Tennessee House chamber floor during a gun control protest. Progressives Reps. Justin Pearson and Gloria Johnson were also involved in this.
When liberal media reported the expulsion of Jones and Pearson and censure of Gloria Johnson, who is white, cries of “good ol boys Republican racism” spread quickly around the nation by liberal media. Yet Tennessee has bent over backwards to correct the past sins of the Democratic segregationists.

According to state Sen. Mark Pody of Lebanon, TN, “Speaker Saxon had no choice but to call for a recess out of fear things would get out of hand.” The three legislators have been disrupting session and bringing crowds of protesters to the people’s galley who are boisterous and disruptive. Unlike states that have full time legislators, Tennessee’s floor sessions only last about three months.

Plato told us, “Good law makes for a good society.” Laws are not made to be broken. Justice is not served if those who feel above the law disrupt legal protocol. When we are in someone’s home we follow their rules. When they are in our home we expect them to follow ours. Decorum is essential in democratic governments to insure that everyone has equal time to debate every issue. Without decorum and parliamentary protocol it would be impossible for our courts and legislatures to serve us.

New York has conducted a major expansion in the filing of red flag law orders at a time when two state Supreme Court justices have ruled them unconstitutional.
As part of the state’s plan to declare shootings a gun violence emergency, enforcement of the red flag law has skyrocketed.
The number of extreme risk protection orders has increased from 95 in 2021 to 584 in 2022, according to data released from the New York State Police. The 283 in the first three months this year sets a pace for about 1,100 – a 1,057% increase.
In August 2021, then-Gov. Andrew Cuomo issued a gun violence state of emergency. Gov. Kathy Hochul issued an executive order in May 2022 that directed the state police to file more temporary extreme risk protection orders.
Since then, two court rulings found the extreme risk protection orders to be unconstitutional.
In December 2022, state Supreme Court Judge Thomas Moran ruled that the extreme risk protection order was unconstitutional. He said the order didn’t provide the “same constitutional protections” as the state’s mental hygiene law.
Last month, state Supreme Court Judge Craig Brown ruled the temporary extreme risk protection order was unconstitutional. The ruling noted that there wasn’t a “requirement of any input from a medical or mental health expert” in the extreme risk protection order, while the mental hygiene law did require a physician’s opinion.
Peter Tilen, a New York lawyer, states on his firm’s website that “extreme risk protections have become very popular in anti-gun states and are a way for government officials to take away the Second Amendment rights of individuals who have not committed any crime.”
Tilem said that the two cases where state Supreme Court judges ruled the orders as unconstitutional would not have a binding effect until they were challenged in the appellate court and affirmed.
William Duffy, spokesman for the New York State Police, said the court rulings have had “no impact” on his department.
“We continue to apply for TERPOs and ERPOs when appropriate,” Duffy stated in an email to The Center Square.

Tilem said a state Supreme Court could sign an injunction that would stop the state police from filing extreme risk protection orders by imposing a statewide injunction if a complaint were filed. But he said that would not stop other law enforcement entities such as a sheriff’s office from doing it.
“We have maintained from the beginning that ERPO cases were an abuse of long-held constitutional principles,” Tilem said in an email to The Center Square. “The idea that a person, who has not committed any crime, could lose a constitutional right with little due process flies in the face of long-held constitutional norms.”
The state of New York courts’ website provides a step-by-step process to file an extreme risk protection order.
The petitioner “can be a district attorney, a police officer, a school official, or a member of the respondent’s family or household,” according to the court website. The petitioner completes an application and includes any support documents and files a “Request for Judicial Intervention” form with the court.
The clerk will take the application and bring the paperwork to the judge, who will decide if a temporary extreme risk protection order will be issued that same day.
If the judge issues the order, a police officer will bring a copy of the order to the respondent’s home and remove any guns.

The National Shooting Sports Foundation supported the court rulings that the Red Flag Law was unconstitutional.
“If an individual is going to be deprived of fundamental constitutional rights, they must be afforded the opportunity to examine and challenge evidence brought against them – they must be afforded due process of law,” the National Shooting Sports Foundation stated in an April press release.
Hochel said the red flag law was making the state safer.
“Protecting New Yorkers is my top priority, and the expansion of the red flag law is taking dangerous, deadly weapons away from those who pose a threat to themselves or others and preventing violence and tragedy,” Hochul said in an October media release. “Working closely with the attorney general and the State Police, we will continue to work to ensure effective implementation of the law to combat gun violence and save lives.”

Don’t worry, what you feel every day as you try to live your normal plebeian lives is all in your heads, not in your pocketbooks and retirement accounts – don’t believe your lying eyes.
That’s been the tune the Federal Reserve and Biden administration have been whistling since the beginning of President Biden’s term.
But as of last week, the Fed is changing up its usual song and dance. The Chairman of the Federal Reserve, Jerome Powell, dipped his toe into telling the truth for once and admitted that we “might” find ourselves in a recession.
So, while President Biden is trying to sell the American people on how great the economy is and how we should thank him for his hard work by giving him another four years, let’s take a look at what the Fed said last week.

Maybe, Probably, It Could Be…
Last week the Fed announced its tenth consecutive interest rate hike, with Chairman Powell dropping this bomb:
“It’s possible that we will have what I hope would be a mild recession.”
Of course, he said that after bumbling through this mealy-mouthed statement:
“The case of avoiding a recession is, in my view, more likely than that of having a recession. But I don’t rule that out, either.”
You may be thinking that it’s no big deal, but again – think of how often President Biden or some other joker is on TV talking about how great the economy is and how well their multi-trillion spending bills have done for the economy.
In contrast, an admission like this from the Fed Chairman is, as Joe Biden once said, a BFD.

Joel Griffith of the Heritage Foundation called the Fed out, stating:
“The Federal Reserve has been an abject failure, particularly over the last few years. What we need is for the Fed to actually be honest with the public, admit that they made a mistake in printing these trillions of dollars, and point out that Congress has been overspending and Congress has been demanding that they print more money.”
That would require Chairman Powell to state something with any confidence and surety, which is just not his natural state of being.

This Is Better, Totally Better
Chairman Powell sure knows how to instill confidence; he added last week that the recent massive bank failures shouldn’t cause alarm:
“Conditions in the sector have broadly improved since early March, and the U.S. banking system is sound and resilient.”
Sure, three U.S banks have collapsed in as many months, but Jerome says the system is ‘sound and resilient,’ right? While what the Chairman said remains to be seen, we know that getting a loan has gotten more challenging for everyone.
The Chairman added this nugget that is really the rub of it all for the average American in this instance:
“These tighter conditions are likely to weigh on economic activity, hiring and inflation. The extent of these effects remain uncertain.”
You don’t need a crystal ball to foresee the effects of banks reining in lines of credit. Unfortunately, that means it’ll be more challenging for Americans to get car loans, personal loans, and lines of credit, both personal and for their small businesses, and all of that impacts the overall economic health of this country. 
After all, in a country that doesn’t save anything, credit is a lifeblood.

The American Bankers Association (ABA) credit index plummeted to its lowest point since the beginning of the pandemic.
The ABA announced that this trend:
“…indicates broad-based expectations for weaker credit market conditions over the next six months among bank economists, and banks are likely to grow more cautious about extending credit.”
But is Uncle Joe worried? No, and according to him, neither should you!

America’s debt took 200 years to accumulate.
Defaulting on it would be more than irresponsible – it’d cut Social Security, raise interest rates, and trigger recession.

Redistribution To ‘The Forgotten’
President Biden is set to release a new campaign ad focusing on all the good he’s done for the economy.
In the ad, President Biden states:
“Folks, my economic plan is about investing in places and people that have been forgotten. … It’s about the dignity of work.”
Mr. Biden adds:
“We’re building an economy from the bottom up and the middle out where no one’s going to be left behind.”
Unless, of course, you’ve been doing all the right things, not expecting a handout from your government.
Case in point, Biden’s new rule just took effect, raising the mortgage fees for borrowers with good credit to benefit higher-risk borrowers.

Allow me to illustrate. Say you are someone like me looking to buy their first house. 
You’ve paid your bills on time every time, saved up money, been a responsible adult with a credit score over 800, and could put a down payment on a home. Now I will pay about $40 extra a month if I get a mortgage over $400,000 (which is guaranteed for the part of the country I live in) so that those with bad credit can pay lower fees. 
Now $40 seems like a little, but over a 30-year mortgage, that equates to an extra $14,400 I get to pay so that others who didn’t do all the right things get to pay less. Do you know what that’s called? Redistribution of wealth and supremely unfair.

Things Are Not Alright
While Mr. Powell and Mr. Biden want to continue to lie to you and tell you that everything is great and everything will be just fine, I will always tell you the truth. Everything is not great, and everything will not be just fine – but you already know that.
The average American family sees $7,000 cut from their paychecks annually due to inflation. Grocery store prices have shot up 8.5% compared to last year.

Everything is more expensive, houses are harder to sell, homes are harder to buy, cars are harder to buy, small businesses are harder to operate, and life is harder to live. We can either continue to believe the lie and live the truth – or we can demand change at the ballot box.
I’ll take a page from Powell’s book and offer this weak prediction – we will conceivably vote out Sleepy Joe and hopefully usher in a new administration, or we might continue on this path for four more years.

Small business week came and went this week, and small businesses took the opportunity to raise a range of concerns about the economy and their future.
The U.S. Chamber of Commerce released a report on the labor market this week, saying that “every state is facing an unprecedented challenge finding workers to fill open jobs,” calling it a “crisis.”

The National Federation of Independent Businesses released a report as well echoing that concern, reporting that out of those business owners hiring or wanting to hire workers, 92% reported that there are “few or no qualified applications for the positions they were trying to fill.”
“The labor market continues to be a big challenge for small business owners,” NFIB Chief Economist Bill Dunkelberg said. “More owners are raising compensation to compete, but labor quality remains a serious problem for owners.”
A new report from the small business network Alignable found businesses have still not bounced back from the pandemic-era shutdowns.
The agency found that 74% of those surveyed are worried about rising interest rates while 27% said these rates already have hurt their businesses.
“Only 34% of small business owners are earning as much or more than they did prior to COVID, now three years after the initial impact,” the group said. “And that statistic has dropped four percentage points from 38% in Jan. So, 66% of U.S.-based SMB owners still aren’t making as much as they did prior to the pandemic.”

The labor market and elevated inflation have been a major problem for small businesses as they work to recover from the pandemic-era shutdowns.
“President [Joe] Biden’s tax increases will hit small to mid-size businesses,” Karen Kerrigan, Small Business & Entrepreneurship Council president and CEO, said in a statement. “The sizable increases take aim at many struggling firms as they work to recover, compete, and operate during an unstable and inflationary period.”
Biden has taken fire in particular for inflation, which was fueled in part by a spike in federal spending and money-printing. Biden spoke from the White House for Small Business Week Monday and touted his economic record.
As The Center Square previously reported, the White House also pointed to pandemic-era assistance programs, the bipartisan infrastructure bill, and the CHIPS and Science act, which is aimed at promoting domestic manufacturing.
Biden painted a rosier picture than small business groups did this week, pointing to programs like the COVID-era Paycheck Protection Program.

“Small businesses are the engine of our economy, the glue, the heart and soul of communities,” Biden said.
The NFIB pushed back on Biden after his speech, though, pointing to the proposed tax increases in his recently proposed 2024 budget. The group recently released an ad buy blasting Biden’s plan, saying the tax increases will hurt businesses that already are struggling.
“The White House is claiming they are ‘closing a loophole’ by subjecting small business income to a new 5% tax, but that claim is false and misleading,” said Kevin Kuhlman, NFIB vice president of Federal Government Relations. “Small businesses are not a tax loophole and ask their elected officials to reject the proposed tax hikes.”

Texas Army and Air National Guard Operation Lone Star troops are making preparations to prevent entry of illegal foreign nationals between ports of entry along the Texas-Mexico border ahead of the public health authority Title 42 ending May 11.
National Guard engineers are continuing to reinforce razor wire barriers along the Texas-Mexico border near El Paso. Additional soldiers have been mobilized to support construction efforts. The reinforced razor wire barriers “will create essential impediments to combat the unprecedented influx of illegal border crossings the end of Title 42 is expected to cause,” the governor’s office says.
“The Texas National Guard is a highly organized and efficient force,” Major Sean Storrud, Task Force West commander, said in a statement. “Although illegal immigration is absolutely a national problem that requires a national solution, the Texas National Guard is doing our part.”
In December, additional personnel and equipment were sent to El Paso to respond to the border crisis, including 200 additional staffers and 40 additional high mobility multipurpose wheeled vehicles (HMMWV) to expand operations in the area, according to the Texas Military Department. This is after 400 personnel were deployed responding to a state of emergency issued by the city’s mayor at the directive of Gov. Greg Abbott.
All sectors along the border increased “their response posture to protect Texas against the flood of migrants and cartel activity streaming into our state,” TMD said.
The end of Title 42 is expected to result in “a massive influx of illegal immigrants allowing criminals to further exploit gaps while federal authorities are inundated with migrant processing,” the Texas Military Department said. Since last December, a designated number of 136th Airlift Wing C-130J cargo aircraft, air crews, support, and response Airmen have been on alert, “prepared to provide any necessary capability at the Governor’s direction,” it said.
The Security Response Force from the 236th MP Company, trained in Civil Disturbance Operations and Mass Migration Response, can be rapidly deployed to border areas, TMD says.

The Department of Public Safety and the Texas National Guard also mobilized numerous assets in the Brownsville area as part of a “mass migration response exercise.”
Soldiers also assisted DPS Brush Teams in monitoring traffic along U.S. 83 near Laredo using night vision technology to enhance visibility into the brush along the highway. The area is frequently used by human smugglers because of its proximity to a nearby residential area, law enforcement officers have explained.
Their efforts are filling “the dangerous gaps left by the Biden Administration’s refusal to secure the border,” Abbott said. “Every individual who is apprehended or arrested and every ounce of drugs seized would have otherwise made their way into communities across Texas and the nation due to President Joe Biden’s open border policies.”
Since Abbott launched Operation Lone Star in April 2021, as of May 5, OLS officers have apprehended over 371,000 illegal foreign nationals. They’ve made over 27,000 criminal arrests, with more than 25,000 felony charges reported. They’ve also seized over 385 million lethal doses of fentanyl, enough to kill more than everyone in the U.S., according to the governor’s office.
On May 12, more people are expected to surge the southern border to enter illegally than at any time in U.S. history. Officials estimate over 13,000 people from all over the world are expected to initially attempt entry every day, which is roughly double the current number. Roughly 40,000 are reportedly waiting in Mexico to enter El Paso, prompting the mayor to declare a state of emergency.

President Joe Biden sent 1,500 National Guard troops to the border to help Border Patrol process illegal foreign nationals into the country, not to expel them or ensure border security, according to a new plan announced by the Department of Homeland Security.
The crisis at the southern border has so far resulted in at least over 6 million people illegally entering the U.S. since January 2021. A record amount of fentanyl and other deadly drugs seized after being brought into the country are enough to kill the U.S. population several times over. Officials have expressed concerns about the unknown volume that hasn’t been seized.
The Biden administration, the Mexican government, and other governmental leaders have entered into agreements to facilitate even more people from all over the world entering the U.S. by “expanding legal pathways” outside of the laws created by Congress. The states and Congress have yet to take action to stop their efforts.

Ahead of the public health authority Title 42 ending on May 11, New York City Health Commissioner Dr. Ashwin Vasan instructed New York health-care providers to undergo several precautions and tests in light of an alarming trend of diseases spreading among illegal foreign nationals arriving from the southern border.
Title 42 was put in place to limit entry to the U.S. to prevent the spread of COVID-19 and other communicable diseases during a public health emergency.

One month before it was lifted, Vasan warned, “COVID-19 continues to circulate in NYC.”
In addition to the coronavirus, he also expressed alarm about those arriving from countries who hadn’t been vaccinated for polio or the chickenpox and were coming from countries with high rates of infectious tuberculosis.
“Many people who recently arrived in NYC have lived in or traveled through countries with high rates of TB,” he wrote in an April 11 letter to physicians and health care providers.
“I am writing now to underscore how critical it is that health care providers take a wide range of considerations into account when working with” foreign nationals arriving from the southern border, he urged.
Everyone arriving must be screened for diseases and viruses, Vasan said, stating that “Vaccination rates for certain diseases are low in some of the most common countries of origin, with rates hovering around 50% for polio as an example.”
He instructed medical practitioners to assess everyone who hasn’t been screened since arriving for symptoms of active TB.
“Health care providers should also assess all immigrants who recently arrived in the U.S. for latent TB infection,” he said.

TB is an infectious disease caused by bacteria that primarily affects the lungs. Those infected with it spread it through the air by coughing, sneezing or spitting. TB’s preventable and curable.
Multidrug-resistant TB “remains a public health crisis and a health security threat,” the World Health Organization states. The organization also recently declared a worldwide health emergency related to the coronavirus was over.
In 2021, 1.6 million people died from TB, including 187,000 people with HIV, the WHO reports. Worldwide, TB is the 13th leading cause of death and the second leading infectious killer, the WHO states. In 2021, an estimated 10.6 million people reportedly had tuberculosis worldwide.
There’s also been an outbreak of chickenpox among families who recently arrived and are staying in shelters and other facilities in New York City, Vasan said. “Most cases have been among unvaccinated children, but cases have also occurred among young adults,” he said. “Children should be screened and vaccinated urgently with all needed recommended immunizations, including those required for school attendance,” he said.
“Young children of immigrant families should be screened for possible developmental or behavioral issues as recommended by the American Academy of Pediatrics,” Vasan also recommended.
Health care providers should also perform blood tests on all arriving children and pregnant and lactating women for lead poisoning, he said. Lead poisoning disproportionately impacts children and pregnant women “who recently arrived in the U.S. Some people may arrive from their countries of origin with lead burdens and compromised nutritional status,” he said.

Those arriving should also be screened for parasitic infections based on their country of origin, Vasan said, and practitioners should also “consider screening for other infectious diseases.”
“Medical screening may identify a wide range of infectious diseases and noncommunicable conditions and is recommended as soon as feasible upon arrival in the U.S.,” he states.
Vasan instructed all practitioners to document and report cases of infection. His letter also provides information on how to potentially bill Medicaid, help illegal foreign nationals apply to the Supplemental Nutrition Assistance Program and Special Supplemental Nutrition Program for Women, Infants and Children, and receive a range of free counseling, legal and other services all at U.S. taxpayers’ expense.
