State Rep. Zooey Zephyr (D-Missoula), a transgender politician who attacked colleagues over legislation that would outlaw transgender operations for kids, was denied her request to return to the Montana House floor after a censure by a court.
Judge Mike Menahan of the District Court ruled on Tuesday that the “requested remedy would compel this Court to meddle with legislative power in a way that exceeds this Court’s jurisdiction.” According to the Montana Free Press, the plaintiffs also want for injunctive remedy that “far exceeds the facts at issue here.”
Even if the court decides the defendants “acted unlawfully under the facts of this case,” the judge continued, “it does not have the authority to issue a broad permanent injunction to effectively remove all legislative authority under Article V Section 10 [of the Montana Constitution] in relation to a single member.”

Zephyr, who filed a lawsuit with residents of Missoula County, said in a tweet that the court’s ruling “undermines the democratic principles our country was founded on” and pledged to “continue standing for my constituents & community to fight for our democratic institutions.”
The Montana state legislature runs a 90-day legislative session every two years, and the current one concludes this week, despite the fact that an appeal is still feasible.
Zephyr hinted to running for re-election by saying, “If we can’t get justice in the courts, we will get it in the voting booth.”

The GOP-led Montana House voted last week to prevent Zephyr, a biological man who identifies as a woman, from attending or speaking at floor sessions after the lawmaker held up a microphone as supporters disrupted the proceedings in the Montana House chamber while chanting, “Let her speak!” The lawsuit was filed on Monday in response, and several people were taken into custody as a result of the commotion.
After Zephyr attacked other lawmakers who support legislation that would tighten restrictions on transgender surgeries for minors, Republican leadership refused to allow her to speak, citing violations of decorum rules.
The measure was enacted on Friday by Republican Governor Greg Gianforte.
Zephyr was penalized for the rest of the current parliamentary session by the censure, although she was still able to cast a distant vote. When the Montana House was about to consider “critical legislation” on the state’s budget, the complaint claimed Zephyr was being silenced.
In the complaint, it was argued that the “unconstitutional” censure should be quickly and ultimately reversed. The plaintiffs’ attorneys named the state of Montana, Montana House Speaker Matt Regier, and Montana House Sergeant-at-Arms Bradley Murfitt as defendants.

According to the Associated Press, state attorneys argued against the need for an emergency move, claiming that the reprimand was given for “good cause” and that “one legislator cannot be permitted to prevent the other 99 from debating issues affecting Montana in a civil and orderly manner.”
Republican Attorney General Austin Knudsen said that the judge’s decision on Tuesday “is a win for the rule of law and the separation of powers enshrined in our Constitution,” according to The Wall Street Journal. According to Scripps, Regier said that “Montana courts have recognized that the Judicial Branch has no power to revise or overrule the power expressly held by the Montana State Legislature to conduct its business.”

A rise in violence, looting and unhindered theft around the U.S. has helped fuel Americans’ rising concerns about crime. Some of the nation’s largest cities are experiencing crime waves in recent years, and new polling shows Americans concerns.
Gallup released new polling Tuesday showing that more Americans are concerned about higher crime, with respondents ranking it as the sixth largest problem facing the nation, behind other issues like “poor leadership” and inflation.
“Democrats’ mentions of crime or violence nearly doubled from 5% in March to 11% in April,” Gallup said. “By contrast, Republicans’ and independents’ views were steady, with Republicans holding at 4%-5% and independents at 2%-4%.”
That rise in concern coincides with a string of viral crime spree moments. In Chicago last month, videos of teenagers running through the streets, looting and attacking bystanders went viral. The city’s new mayor-elect, Brandon Johnson, replacing outgoing long-time mayor Lori Lightfoot, spoke out saying that “demonizing” the teens is wrong.
“We have to keep them safe too,” he said.
Those comments drew backlash for the new mayor of Chicago, a city that saw a major spike in crime last year. According to the Chicago Police Department’s end-of-year report for 2022, in the last four years, murder has risen 20% and motor vehicle theft has risen 114%. While some crimes like burglary saw a drop of 35% in that time, crime in the city overall is up 19%.
National police groups point to the lack of support local departments receive in light of several recent high-profile police shootings like the death of Michael Brown or George Floyd. Police in many areas have pulled back, fearing a close call will make then a national villain in what is often called the “Ferguson effect.”

The groups also point to liberal District Attorneys that have arisen in many of the nation’s largest cities who are lax on prosecuting many crimes and in some cases don’t prosecute them at all.
“This is a direct byproduct of an utter breakdown in the criminal justice system. Across the country, we have prosecutors who refuse to prosecute and police who aren’t allowed to police,” Jason Johnson, president of the Law Enforcement Legal Defense Fund, told The Center Square. “The justice system isn’t a revolving door, it’s a merry-go-round. The situation is especially demoralizing and debilitating for law enforcement who have a front row seat to the chaos and misery that has been unleashed.”
Critics have also pointed to liberal bail reform policies which. make it easier for criminals to quickly get back on the streets. Last week, New York leaders once again discussed changes to their bail laws. Four years ago, New York rolled back bail requirements for a range of even very serious offenses, releasing violent criminals back on the streets quickly and sparking backlash.
“The police are just one component of the broader criminal justice system,” Laura Cooper, executive director of the Major Cities Chiefs Association, told The Center Square. “Issues such as bail reform and juvenile accountability are two driving factors and MCCA members have countless examples of repeat offenders cycling through the criminal justice system at a high rate and without consequence.”
In the District of Columbia, rising crime collided with vastly different political ideas of how to handle local policing. Liberal city council members in Washington, D.C. passed a plan last year to lessen a range of criminal penalties. Republican in the U.S. Congress, which has jurisdiction over much of D.C.’s government, though local officials dispute that, vetoed the liberal effort, pointing to rising crime.
The D.C. Metro Police Department’s latest data shows in the last year that homicides are up 19%, sex abuse is up 58%, motor vehicle theft is up 107%, arson is up 300%, and crime overall is up 26%.
Unfettered theft has become a major them as well. In San Francisco, local leaders largely decriminalized shoplifting and passed policies facilitating a surge in homelessness and open-air drug use. Now, many businesses have packed up and left the city, citing a huge uptick in theft.

About this time last year, Walgreens announced it was shutting down 22 stores.
“Organized retail crime continues to be a challenge facing retailers across San Francisco and we are not immune to that,” Walgreens said in a statement. “Retail theft across our San Francisco stores has continued to increase in the past few months to five times our chain average. During this time to help combat this issue, we increased our investments in security measures in stores across the city to 46 times our chain average in an effort to provide as safe environment.”
A San Francisco Whole Foods made national headlines this week for announcing it was shutting down because of rampant theft and dangerous incidents for employees. Target and Walmart executives have made similar complaints about shoplifting, and viral videos have shown thieves filling up garbage bags with merchandise before walking out without being stopped.
These cities and viral moments typify an ongoing debate about the role of police amid rising violence and ongoing racial tensions following a series of deaths at the hands of police.
“We must shake our collective amnesia about how America ushered in decades of unprecedented safety,” Johnson said. “If we want to make our communities safe, we need to return to proactive policing and prosecuting, not coddling, criminals.”

In response to outgoing Chicago Mayor Lori Lightfoot blaming Texas Gov. Greg Abbott for illegal foreign nationals flooding the Windy City, he told her to call on President Joe Biden to secure the border and fix the problem he says the president created.
Lightfoot wrote Abbott Sunday calling on him to appeal “to your better nature” to stop the “inhumane and dangerous action” of busing illegal foreign nationals to Chicago.
Last August, Abbott began a busing strategy to assist Texas border communities inundated with foreign nationals who’d illegally entered the U.S. and were being unlawfully released into Texas by busing them to so-called sanctuary cities. Since then, over 8,000 voluntarily agreed to receive free, taxpayer-funded transportation to Chicago, Abbott said.
Lightfoot said their arrival “has resulted in a critical tipping point in our ability to receive individuals and families in a safe, orderly and dignified way. We simply have no more shelters, spaces or resources to accommodate an increase of individuals at this level, with little coordination or care, that does not pose a risk to them or others.”
She accused the governor of “telling them to go to Chicago” even though all who are bused voluntarily signed a waiver and picked which of four cities they wanted to go to: Chicago, Washington, D.C., New York or Philadelphia.
She said the 8,000 presented a “completely untenable” situation. She also argued, “The national immigration problem will not be solved by passing on the responsibility to other cities” while also claiming, “this is not a state v. state or city v. city problem.”
“For the good of our country and the individuals who are seeking safety in refuge, let’s work together to find a real solution,” she said, which “will never be the unilateral busing of migrants to cities like Chicago.”

In response, Abbott clarified that while Texas is on the frontlines of a catastrophe created by the Biden administration, what’s happening isn’t “a Texas problem” but is a “problem for the entire United States.”
In a letter sent to Lightfoot on Monday, he said it was “ironic” for a mayor of a self-declared sanctuary city “to complain about Chicago’s struggle to deal with a few thousand illegal immigrants, which is a fraction of the record-high numbers we deal with in Texas on a regular basis. Texas border towns like Eagle Pass, Brownsville, and Laredo – and even bigger cities like El Paso – cannot handle the flood of illegal immigrants rushing across our southern border.”
In March, for example, Border Patrol agents in the Del Rio Sector of Texas apprehended 24,715 illegal foreign nationals and reported 11,867 gotaways – those who illegally enter primarily between ports of entry and intentionally seek to evade capture by law enforcement.
Gotaways have totaled well over 1 million since Biden’s been in office, the majority of them have been reported in Texas, Border Patrol agents have reported to The Center Square.
The Biden administration has announced its plan to usher into the U.S. even more foreign nationals ahead of the public health authority Title 42 ending May 11. Abbott points to estimates that up to 13,000 people are expected to illegally cross the U.S.–Mexico border every single day after May 11.
“Some reports indicate that there are nearly 35,000 waiting to cross into El Paso as soon as Title 42 expulsions are no longer in effect,” he added. “If Chicago can’t deal with 8,000 in less than a year, how are small Texas border communities supposed to manage 13,000 in just one day?” he asked.
He also pointed out that “illegal crossings will be accompanied by criminal activity, gang violence, and deadly drugs like fentanyl. These problems do not stay in border communities in Texas. They make their way all throughout the country, including to the streets of Chicago. Innocent Americans are put at risk every day by these open-border policies.”

Since Abbott launched the state’s border security mission Operation Lone Star in March 2021, Texas law enforcement officials have apprehended more than 369,000 illegal foreign nationals and made over 27,000 criminal arrests, with more than 25,000 felony charges reported. They’ve also seized more than 383 million lethal doses of fentanyl, enough to kill everyone in the U.S., according to data from the governor’s office as of April 28.
It the mayor really wanted to “work together to find a real solution,” Abbott said, she’d “call on the Biden Administration to do its job by securing our border, repelling the illegal immigrants flooding into our communities, classifying the Mexican drug cartels as foreign terrorist organizations, and intercepting the deadly fentanyl that is endangering our country.”
He also said Texas will continue to bus people north until the president “secures the border to stop the inflow of mass migration.”

Republican presidential candidate Donald Trump announced a “higher education” platform he’d implement in a return to the White House which includes a plan to seize endowments from universities that engage in racial discrimination “under the guise of equity.”
Trump’s latest effort to reform education in America comes via a campaign video.
“For many years, tuition costs at colleges and universities have been exploding, and I mean absolutely exploding while academics have been obsessed with indoctrinating America’s youth,” he stated.
“The time has come to reclaim our once great educational institutions from the radical Left, and we will do that.”
The plan involves imposing “real standards,” defending the “American tradition,” removing diversity, equity, and inclusion bureaucrats, and making education affordable again.
“When I return to the White House, I will fire the radical Left accreditors that have allowed our colleges to become dominated by Marxist Maniacs and lunatics,” added Trump.

Trump Going After University Endowments
Another vital aspect of Trump’s plan includes directing the Department of Justice to pursue civil rights investigations into institutions that engage in racial discrimination.
The former President intends to go after the endowments of such universities through taxes or budgetary measures.
“Schools that persist in explicit unlawful discrimination under the guise of equity will not only have their endowment taxed, but through budget reconciliation, I will advance a measure to have them fined up to the entire amount of their endowment,” said the former President.
He contends the seized funds would then be distributed to “victims of these illegal and unjust policies.”

The Fight to Fix Education
Education seems to be a very important aspect of Trump’s presidential campaign. He has produced multiple videos discussing how he intends to reform an institution that has become a cesspool of far-left socialist groupthink.
Earlier this year, the former President announced his vision for saving American education and giving “control of schools back to parents.”

Trump also promised to cut federal funding for schools that push critical race theory or extreme gender ideology on their students.
He called for an Education Department civil rights investigation into race-based discrimination and an ‘aggressive’ pursuit of freedom of religion violations in schools.
Now, Trump claims he’ll get the DOJ involved with those racial discrimination cases while seizing endowments, a move that represents a step above and beyond simply cutting funding.

The Republican frontrunner has also vowed to adopt a parental bill of rights that includes “complete curriculum transparency” as a means for parents to fight back against the “pink-haired communists” littering the education landscape.
“Colleges have gotten hundreds of billions of dollars from hard-working taxpayers and now we are going to get this anti-American insanity out of our institutions once and for all,” he concluded.

Senator Ed Markey reiterated calls for Supreme Court Justice Clarence Thomas to resign in a social media posting on Tuesday.
The short tweet reads, “Clarence Thomas must resign.”
Markey (D-MA) is likely the highest-ranking Democrat to date calling for Thomas’ resignation. Representative Alexandria Ocasio-Cortez (D-NY) has been very vocal in the past about demanding his ouster, along with a handful of other House members.
The controversy stems from a recent report by the left-leaning outlet Pro Publica alleging billionaire Harlan Crow, a GOP donor, provided trips and gifts to Thomas that were not disclosed.
Following the allegations of impropriety, Thomas explained accurately that the gifts in question were from close personal friends and, as they “did not have business before the Court” it “was not reportable.”
He said he would amend his financial disclosure forms to comply with changes made to disclosure rules that were announced last month.
Markey’s calls for his resignation began last week when he declared the hit job against Thomas was evidence that the Supreme Court Justice’s “reputation is unsalvageable.”

Ted Cruz Reveals Why Democrats REALLY Want Clarence Thomas to Resign
Senator Ted Cruz, speaking during a Senate Judiciary Committee hearing on Supreme Court Ethics Reform on Tuesday, absolutely tore apart the Democrats’ argument suggesting Clarence Thomas should resign.
“Senate Democrats and their lap dogs in the media are engaged in a two-fold political campaign,” he explained.
“Number one – to delegitimize the Supreme Court of the United States because they are angry that there are a majority of constitutionalists on the court,” added Cruz. “But number two, very directly, this is a political campaign designed to smear Justice Clarence Thomas.”

And the reason behind it is quite simple.
“The Left despises Clarence Thomas, and they do not despise him because he’s a conservative,” Cruz alleges. “The Left despises Clarence Thomas because he is a conservative African American.”
Cruz then made a reference to Thomas’s own remarks at his confirmation hearing over 30 years ago, an effort the Justice described at the time as an attempted “high-tech lynching for uppity blacks” by Democrats.

Cruz ran off a list of other justices who have taken similar trips and accepted gifts in the past, noting there was no outrage or demands for them to resign. There wasn’t even mention of it.
“I would point out Justice Kagan has done the same thing. Justice Sotomayor has done the same thing,” he said. “And yet, none of my Democrat colleagues care, because this is a political attack directed at a justice they hate.”

They Hate Him Because He’s Black
None of this is new, of course. The Political Insider reported just over a year ago that Democrats were holding a hearing to explore the possibility of impeachment for Supreme Court justices.
The controversy at that time was over Thomas’s wife Virginia ‘Ginni’ Thomas, who exchanged text messages with then-White House chief of staff Mark Meadows about alleged election fraud after the 2020 election.
If it’s not one manufactured scandal, it’s another. And there will certainly be more down the line.
Why? Because Democrats really hate that Clarence Thomas is the most successful, longest-tenured black Supreme Court justice – and he’s a Constitutional conservative. Demographic elements are supposed to be their platform. That is why Ketanji Brown Jackson was appointed to the Court based almost exclusively on her skin color and gender.
During an interview on Fox News over the weekend, Cruz accused Democrats of having a “special degree of hate” for Thomas because he is a black man.
“Democrats hate Justice Thomas and they save a special degree of hate for him because he is a Black man,” he said. “And their view is that an African American is not allowed to be a conservative [and] is not allowed to disagree with left-wing orthodoxy.”

Clarence Thomas is the longest-serving justice, the second black justice, and the most conservative member currently serving on the Supreme Court.
That’s the true reason he is being targeted.
He is a historic figure who should be celebrated as such.
Markey, meanwhile, is essentially a Squad member in pants and has pushed for such groundbreaking and ‘historic’ legislation as those supporting censorship under the guise of … “algorithmic justice.”

“Democrats can have disagreements based on law, but this attempt to delegitimize the court this attempt to personally smear Clarence Thomas is dishonest,” Cruz fired back.
“And everyone in the media echoing it is participating in a shameful reprise of 1991’s high-tech lynching.”

Media Matters For America (MMFA) released behind-the-scenes videos of Tucker Carlson that were meant to embarrass him … and it backfired spectacularly.
The videos were posted to social media by Matthew Gertz, a senior fellow for the extreme leftist blog.
Gertz describes some of the content of the clips as “creepy” as Carlson speaks off-air while preparing for an interview with Piers Morgan.
What was meant to be mortifying for Carlson and portray him in a negative light turned into absolute hilarity when, in one of the clips posted by Gertz, the former Fox News host tells MMFA to “go f*** yourself.*
The video shows him mentioning that somebody’s girlfriend is “yummy” before stating he is “just kidding, in case this is being pulled off the bird.”

Tucker Carlson Hammers Media Matters In Their Own ‘Bombshell’ Video
Carlson then notes that the second thing he’d like to say is that he’s “totally kidding, I don’t even know what his girlfriend looks like, and if I did, I would not find her yummy.”
So what you’ve got is some incredibly tame locker room talk and a disclaimer from Tucker Carlson noting that he’s kidding because he knows places like Media Matters would take it out of context.
And the second they get their hands on it, Gertz … posts it and takes it completely out of context.
Media Matters likes to own themselves rather often. Their staff of top-notch bloggers sit around all day and watch Fox News then interpret what they’ve seen for their low-information viewers. And the results are usually just like this – a whole lot of nothing.
In another clip, Carlson jokes about discussing sexual “technique” with Morgan.
“If we’re going to talk about sex, I’d love to hit some of the fine points of technique, but, you know, but it’s your show,” he quips. “It’s totally up to you.”

On Monday, the outfit released another behind-the-scenes video showing the former Fox News host complaining about the network’s streaming service Fox Nation.
In that clip, Carlson states the service “sucks” and has a poorly functioning website. Which, if you’ve ever used Fox Nation, is undeniably accurate.

Viewers Rip Media Matters
Viewers couldn’t help but mock Media Matters and Gertz for their big bombshell video release meant to smear Tucker Carlson.
“Why would you tweet this self-own?” the Daily Signal replied.
“Are you aware that everything you are posting about Tucker Carlson is just making him look cooler?” added political commentator Greg Price.

Media Matters should take Tucker’s advice.

Pundit Matt Dawson added, “I didn’t like Tucker Carlson until I saw these clips, now he seems ok.”
Most of the replies suggested Media Matters take Carlson’s advice.

One has to wonder who is leaking these video clips to Media Matters of all places. It’s almost as if some interns at Fox News are messing with them, sending the videos and snickering about how it’s going to backfire.
It’s rather obvious Media Matters was trying to use the locker room banter about ‘sexual technique’ and a ‘yummy’ girlfriend to capitalize off reports that suggest Carlson was fired by Fox News over “misogynistic” comments made to a former producer.
Instead, it was Media Matters that came off looking like fools.
